Yelp and the News/Media Alliance have petitioned a U.S. judge to disqualify a reputable U.S. law firm from defending Google in the Department of Justice’s ad tech lawsuit. The two organizations argue that the law firm, Paul, Weiss, Rifkind, Wharton & Garrison, has a conflict of interest due to its previous involvement as their advocate on issues related to the case.

While Yelp and News/Media Alliance are not defendants in the litigation, they have been targeted by Google’s subpoenas. Google has sought information from Yelp, the service-recommendation site, and the News/Media Alliance in an effort to challenge claims that it has misused its market dominance in web advertising. This latest technology trend has raised eyebrows within the industry, with many stakeholders closely watching the unfolding events.

The lawyers representing Yelp and the media group stated that this case revolves around a significant law firm allegedly switching sides against former clients to represent an accused monopolist. Paul Weiss, however, maintains that its representation of Google is entirely appropriate. Yelp chose not to make further comments beyond its court filing, while Google did not immediately respond to requests for comment.

The request to disqualify Paul Weiss marks another contentious point in the litigation concerning ethical considerations. This lawsuit is one of two cases in the U.S. accusing Google of antitrust violations. Google has consistently denied any wrongdoing.

Yelp disclosed that it enlisted Paul Weiss in 2016 for legal advice on antitrust matters. Jonathan Kanter, who is now heading the Justice Department’s antitrust division, was part of the Paul Weiss team that represented Yelp. Google is now seeking information from Yelp about its advertising technology business and other subjects, including Yelp’s engagement letters, invoices, and bills associated with its ties to Paul Weiss.

Earlier this month, Google’s request to bar Kanter from leading the case was denied by Judge Brinkema. Google had contended that Kanter should be disqualified due to his previous work for Yelp and other Google critics in private practice.

Paul Weiss, a New York-based law firm with approximately 1,000 lawyers worldwide, is also representing Amazon.com in various antitrust lawsuits. The trial in the ad tech case against Google is expected to commence next year.

This case, United States et al v. Google LLC, is being heard in the U.S. District Court for the Eastern District of Virginia.
